Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you ("Customer," "you") and EdgeAPI Labs B.V., a private company with limited liability (besloten vennootschap) incorporated in the Netherlands ("EdgeAPI," "we," "us"). By accessing or using the EdgeAPI platform, including any related websites, APIs, CLI tools, or documentation (collectively, the "Service"), you agree to be bound by these Terms.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, do not access or use the Service.
2. Description of Service
EdgeAPI provides a serverless edge computing platform that allows customers to deploy and execute custom code ("Functions") across a globally distributed network of edge locations. The Service includes runtime execution environments, edge storage primitives (KV and D1), build pipelines, dashboard tooling, and supporting APIs.
We continuously improve the Service. We reserve the right to add, modify, deprecate, or remove features with reasonable notice. Material changes affecting paid plans will be communicated at least 30 days in advance.
3. Account Registration
To use the Service, you must create an account and provide accurate, current information. You are responsible for safeguarding your account credentials and API tokens, and you accept responsibility for all activities that occur under your account. Notify us immediately at security@edgeapi.date if you suspect unauthorized access.
You must be at least 16 years of age to use the Service. The Service is not designed for use by children.
4. Acceptable Use
You agree not to use the Service to:
- Distribute, host, or execute malware, ransomware, viruses, or any malicious code
- Engage in cryptocurrency mining of any kind
- Distribute content that infringes intellectual property, trademarks, or other rights of third parties
- Send unsolicited bulk communications (spam) or perform email enumeration attacks
- Conduct denial-of-service attacks against any third party
- Scrape, harvest, or extract data from third-party services in violation of their terms
- Distribute child sexual abuse material or content depicting non-consensual intimate imagery
- Violate applicable laws, including export control, sanctions, and data protection laws
- Reverse engineer the Service, attempt to bypass security measures, or probe for vulnerabilities outside our published bug bounty program
We reserve the right to investigate suspected violations and to suspend or terminate accounts that violate these provisions.
5. Customer Code and Data
Your code is your IP. You retain all right, title, and interest in and to the Functions, content, configuration, and data you submit to the Service ("Customer Content"). You grant EdgeAPI a limited, non-exclusive, worldwide license to host, execute, transmit, and store Customer Content solely as necessary to provide the Service.
We do not claim ownership of Customer Content. We do not use Customer Content to train machine learning models. We do not access Customer Content except as required to operate the Service, respond to legal process, investigate suspected violations of these Terms, or upon your authorized request for support.
6. Subscription and Payment
Paid plans are billed in advance on a monthly or annual basis. Usage-based charges (CPU-ms overages, additional storage) are billed at the end of each billing period. All fees are exclusive of applicable taxes (VAT, sales tax, etc.) which we collect where required.
You authorize us to charge your designated payment method for all fees due. If a payment fails, we will notify you and may suspend the Service after 7 days of non-payment.
7. Cancellation and Refunds
You may cancel your subscription at any time via the dashboard. Upon cancellation, your account remains active through the end of the current billing period, after which it is downgraded to the free tier or terminated.
We do not provide refunds for partial months or unused capacity, except where required by law or as a discretionary courtesy. Annual prepaid plans are refundable on a pro rata basis within 30 days of the renewal date.
8. Intellectual Property
The Service, including all software, designs, trademarks ("EdgeAPI"), logos, documentation, and the underlying infrastructure, is owned by EdgeAPI and protected under Dutch and international intellectual property laws. We grant you a limited, revocable, non-exclusive license to access and use the Service for your internal business purposes during your subscription term.
Customer feedback, suggestions, and feature requests submitted to us may be used by EdgeAPI without obligation or compensation.
9. Confidentiality
Each party may have access to confidential information of the other ("Confidential Information"), including but not limited to product roadmaps, pricing, technical architecture, and Customer Content. Both parties agree to use Confidential Information only to perform under these Terms and to protect it with the same degree of care they use for their own confidential information, but in no event less than reasonable care.
10. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN OUR SERVICE LEVEL AGREEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EDGEAPI'S AGGREGATE LIABILITY ARISING FROM OR RELATED TO THESE TERMS WILL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. IN NO EVENT WILL EITHER PARTY BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms limits liability that cannot be limited under Dutch law (including liability for fraud, willful misconduct, or gross negligence).
11. Indemnification
You agree to indemnify, defend, and hold harmless EdgeAPI and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Customer Content, (b) your use of the Service in violation of these Terms, or (c) your violation of any applicable law or rights of any third party.
12. Termination
You may terminate your account at any time. We may terminate or suspend your access to the Service immediately, without prior notice, for material breach of these Terms, suspected fraud or illegal activity, or non-payment.
Upon termination, you will have 30 days to export your Customer Content via the standard export tools, after which we will delete it from active systems (subject to backup rotation periods described in our Privacy Policy).
13. Governing Law and Disputes
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws principles. Any dispute arising from or relating to these Terms shall be brought exclusively in the competent courts of Amsterdam, the Netherlands. Notwithstanding the foregoing, EdgeAPI may seek injunctive or equitable relief in any court of competent jurisdiction.
14. Changes to Terms
We may update these Terms from time to time. Material changes will be announced via email and on our website at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
